الأشياء المحرمة استهلاك


الحمد لله رب العالمين، رب العالمين، الله يرفع أكثر من رتبة سيدنا محمد وعلى آله ويحفظ مجتمعه من ما يخشى على ذلك. نسأل الله تا علاء ³ قال انه يعطي لنا جميعا حسن النية.

يقول ³ تا علاء الله في القرآن:

  ) حرمت عليكم الميتة والدم ولحم الخنزير وما أهل لغير الله به والمنخنقة والموقوذة والمتردية والنطيحة وما أكل السبع إلا ما ذكيتم وما ذبح على النصب (

(Hourrimat ³ alaykoumou L-maytatou وا D-دامو وا lahmou L-khinziri وا أماه 'ouhilla lighayri L-اهي بيهي WA L-mounkhaniqatou WA L-mawqoudhatou WA L-moutaraddiyatou وا أماه' أكالا S-sabou ³ أو انها بلدي dhakkaytoum وا بلدي dhoubiha ³ N-علاء nousoub)

[سورة المائدة / 3]

وهو ما يعني: "أنت ممنوعة من maytah والدم واللحم، ولحم الخنزير واللحوم من الحيوانات المذبوحة باقتباس اسم آخر من ذلك من الله، لحوم الحيوانات خنقا، لحوم الحيوان تتلقى الضربات الموت، لحوم الحيوانات النافقة يسقط من أعلاه، لحوم الحيوانات الميتة بواسطة قرنيه، واللحوم من الحيوانات التي كانت تؤكل من قبل الحيوانات البرية إلا إذا كنت قد تعرضت قبل الذبح، و[يمنع] المذبوح قربانا للأوثان ".

هذا 'الآية يشمل الحظر المفروض على تناول أشياء معينة.

Ø أول شيء هو maytah. وmaytah هو أي حيوان الذي مات بخلاف ما تم استهلاكه الحيوان القانونية الذي قتل بطريقة تتفق مع شريعة الإسلام. هذا هو الحيوان الذي مات دون أن قتل بطريقة تتفق مع شريعة الإسلام التي تجعلها مشروعة للاستهلاك.

الحيوانات هي من نوعين: هناك الحيوانات التي هي مشروعة للاستهلاك، وهناك الحيوانات التي ليست مشروعة للاستهلاك.

الحيوان الذي لا يحل للاستهلاك، مثل الأسد، على سبيل المثال، بغض النظر عن الطريقة التي مات، فإنه يعتبر maytah، ويحظر استهلاكها. حتى لو انت القتيل، لا يجوز أن يكون مشروعا للاستهلاك.

أما بالنسبة للحيوان المشروعة للاستهلاك، مثل الأغنام، إذا تم ذبحها بطريقة تتفق مع شريعة الإسلام، فمن مشروعة للاستهلاك، وسوف تكون نظيفة. من الخلاف يجعل استهلاك الحيوان القانونية يجب تلبية شروطه. من بين أمور أخرى، لا يمكن إلا أن يتم ذلك من قبل مسلم، مسيحي أو يهودي.

استهلاك الحيوان القانونية التي يتم ذبحها من قبل مسيحي أو يهودي، حتى لو كان قتل لم يقله bismi L-لاه، أن الحيوان هو المسموح للاستهلاك.
للسلبيات، وذبح حيوان مسلم، إذا مسلم، قتل لا يذكر اسم الله، وفقا لالإمام الرماد الشافي ³ هو iyy مشروعة للاستهلاك.
بعض الأئمة الآخرين، سواء عمدا يتخلى عن البسملة، وسوف يذبح الحيوان لا يكون مشروعا للاستهلاك.

وفقا لالإمام الرماد الشافي ³ iyy حقيقة أن أقول bismi L-لاه في الذبح، انها مجرد السنة وإذا تخلى عن عمد الحيوان يجوز للاستهلاك.
المذبحة التي يتم تنفيذها بواسطة مرتد - شخص كان مسلم والذي هو من إهانة الإسلام الله على سبيل المثال، أو وجود اعتقاد السيئة التي جعلته يفقد مكانته باعتباره مسلم - حتى إذا كان الحيوان ذبح، فهو يعتبر maytah.

وضع بعض الدجاج في الآلات ويمرر سلسلة دون أن يكون هناك شخص يدفع الزر في كل مجموعة تمر لأنه إذا كان هناك شخص يدفع زر وهناك شيء يأتي قبالة عنق الدجاجة، إذا كان هذا الشخص هو مسلم، مسيحي أو يهودي، لم يصح، ولكن أنا أتحدث آلات حيث يتم وضع الحيوانات واضغط الزر مرة واحدة فقط وبعد أن الحيوانات تنفق السلسلة. إذا كان هناك مسلم، مسيحي أو يهودي يضغط على الزر، وسوف الوحش الأول يكون مشروعا للاستهلاك والباقي لا يحل أكله.

أما بالنسبة للأداة التي من خلالها قتل، فمن الضروري أن هو شيء حاد وليس بالسن، مسمار أو عظم. أنها ليست صالحة للذبح مع الأسنان أو مع اظافر أو العظام. النبي (صلى الله عليه واهو 3alayhi وسلم) حرم لذبح مع الأسنان والأظافر. وقد استخلص العلماء أن النهي عن ذبح باستخدام العظام لأن النبي في الحديث حيث لا استخدام الأسنان لقتل، برر هذا من حقيقة أن الأسنان هي العظام، ج وهناك أن العلماء قد خلص إلى أنه غير صالح لاستخدام عظام الحيوانات للذبح.

وmaytah هو أي الحيوان الذي مات دون أن قتل بطريقة تتفق مع شريعة الإسلام التي تجعلها مشروعة للاستهلاك. قلنا "لا انه قتل" لأنه في العام لا تذبح ذلك، ولكن هناك حالات أخرى خاصة حيث الحيوان يجوز للاستهلاك من دون ذبح، على سبيل المثال، إذا كان الجنين هو القول إذا كنت ذبحت شاة وهي حامل، جملا الحامل، فمن قانوني إذا قتل جنينها بسبب هذه المذبحة، فمن مشروعة للاستهلاك، سواء في قتل الأم والجنين يموت في قتل الأم، والأم يموت والجنين في رحم أمه ماتت في هذه الحالة فإنه يجوز استخدام دون أن يذبح لأن النبي (صلى الله واهو 3alayhi وسلم) قال:
 
"ذكاة الجنين ذكاة أمه"

وهو ما يعني: "إن ذبح الذي يجعل استهلاك الأم قانوني يجعل يحل الجنين الاستهلاك."

إذا، قتل الأم والجنين يأتي على قيد الحياة بعد فمن الضروري أن تستهلك قتل. إذا كان يعيش خارج وراحة لمدة يومين أو ثلاثة أيام على قيد الحياة بعد أن يموت، فإنه لا يحل للاستهلاك لأنه لن يموت بعد ذبح أمه.

حالة خاصة أخرى هي حالة الصيد. ولذلك فمن يحل أكله الدابة التي تم اصطيادها، وهذا هو القول، قتل على يد أحد الأسهم أو الرمح أو ما هو هذا حول، شيء أن شريحة ويقتل. في هذه الحالة، فإنه يجوز للاستهلاك. إذا كان حيا مع السهم. فمن القانونية لمطاردة مع تزلف أو رابتور، مع بعض الشروط. قبل العرب تصاد أو باستخدام الكلاب وغيرها من الحيوانات البرية مثل الفهد الصياد أو باستخدام نسر أو نسر أو شيء من هذا النظام، ولكن مرة أخرى هناك شروط: يجب أن يكون الحيوان تدريب لمطاردة، أن يقال للحيوان الذي تم تدريبهم على مطاردة، لا بد له من تحقق شروط معينة. أيضا في هذه الحالة فإنه من الضروري أن الذي يصطاد باستخدام هذا الحيوان هو مسلم، مسيحي أو يهودي.


ما هي الحيوانات التي هي قانونية لاستخدام وما هي الحيوانات التي لا يحل أكله؟

أي حيوان في الاحترام التي كان هناك نص صريح في القرآن أو الحديث أو أهل العلم على أنه يجوز قانونا للاستهلاك، فإنه يجوز للاستهلاك. وأي حيوان في الاحترام التي كان هناك نص صريح في القرآن الكريم، الحديث الشريف، وكان هناك إجماع بين العلماء أنه من غير القانوني لاستخدام، وسوف تكون غير مشروعة للاستهلاك.

القاعدة العامة هي أن أي حيوان فيما يتعلق التي لا يوجد نص صريح في القرآن أو أو في الحديث، أو الذي أعلنت فيه العلماء بالإجماع مشروعة للاستهلاك و حول أي أنه لا يوجد نص صريح في القرآن أو أو في الحديث، أو الذي أعلنت فيه العلماء على الاستهلاك غير القانوني وبنحو الذي لم يكن هناك أي أمر لقتل أو حظر لقتل أي حيوان كان الأمر كذلك، وأن العرب ينظر اليها على انها جيدة للأكل، فإنه يجوز للاستهلاك. وأي حيوان كان الأمر كذلك، وأنه رفض العرب للمستهلك، وهذا هو القول، أنها لم تكن كغذاء جيد، فإنه من غير القانوني للاستهلاك.

أي حيوان حوالي التي كان هناك نص صريح ينص على استهلاك المحظورة، سواء في القرآن الكريم، في الحديث الشريف أو إجماع من العلماء، النهي للاستهلاك.

  "ويحل لهم الطيبات ويحرم عليهم الخبائث"

وهو ما يعني: "الله ما يضفي الشرعية على ما يعتبرونه الطعام الجيد وليس ما نخلي مسئوليتنا في الغذاء"

من بين الحيوانات التي كانت هناك واضحة، معلنا ممنوع للاستهلاك، وهناك لحم الخنزير، وهناك بغل كما أفيد في الحديث الذي رواه أبو داود، وحمار كما أفيد مسلمة، كانت هناك أيضا حظر أي حيوان له أنياب قوية مع الذي يهاجم فريسته ويمكن أن تقتل أو تسبب ضررا خطيرا للكلب، مثل الأسد، النمر، الذئب، الكلب، الفيل، ابن آوى، والفهد، التمساح وما هو هذا النظام والدردشة أيضا. للسلبيات، لا يعتبر الثعلب حيوان مع الأنياب قوية.

من بين الطيور سمح لجميع الطيور التي لها مخالب قوية مع التي تهاجم فرائسها والتي يمكنهم من خلالها قتل أو جرح فرائسها. لا يشير الحكم الى ما إذا كان أو لم يتم التوصيل بيل، وجاء الحكم في الحديث هو أن أي حيوان لديه قوية مع الأنياب التي يمكن أن تقتل أو تجرح بجدية فرائسها وأي الطيور التي لديه مخالب قوية معها الهجمات كانت محظورة فريسته للاستهلاك، مثل الصقور والنسور، النسور، الصقور، وما هو من هذا النظام.

هناك أيضا الحيوانات التي هناك نص يحرم القتل، وبالتالي غير قانوني للاستهلاك. أي حيوان في الاحترام التي كان هناك نص يحرم القتل، فمن غير مشروعة للاستخدام، كما هو طائر الهدهد له وكأنها تاج على رأسه، وهو نوع من النمل يسمى "ل النمل لم soulaymani "هي النمل كبيرة مع سيقان طويلة.

جميع الحيوانات المائية، وهذا هو القول، التي تعيش في البحر أو الأنهار، في بركة مشروعة للاستهلاك بدونها يذبح. عندما نقول "الحيوانات المائية"، ويهدف إلى أن الحيوانات التي تعيش حصرا في المياه.

Ø والشيء الثاني الذي يحظر في 'آية، على تدفق الدم بسبب وجود آخر' الآية التي تقول هذا هو كلمة الله:

  ) قل لا أجد فيما أوحي إلي محرما على طاعم يطعمه إلا أن يكون ميتة أو دما مسفوحا (

وهو ما يعني: "أقول، وأنا لا أجد في ما أوحي لي شيء ممنوع كغذاء إلا maytah وتدفق الدم."

"دم" لأن الكبد والطحال والدم أن الله قد خلق في الحالة الصلبة في أجسام الحيوانات والبشر، والكبد والطحال من استهلاك الحيوان القانونية هي مشروعة للاستهلاك.

قال النبي (صلى الله عليه واهو 3alayhi وسلم):

"أحلت لكم ميتتان ودمان السمك والجراد والكبد والطحال"
وهو ما يعني: "هناك نوعان من القتلى ونوعين من الدم كنا أحل للاستهلاك: السمك والجراد والكبد والطحال"
[رواه ابن ماجه]

Ø الشيء الثالث الذي هو ممنوع في 'الآية هو اللحم من الخنزير، كل ما يأتي من استهلاك لحم الخنزير غير قانوني ولكن في' آية ونقلت الصحيفة عن أكل لحم الخنزير لأنه اللحوم التي 'فإنه عادة ما يكون في الحيوان.

Ø الشيء الرابع: "وا أماه 'L-اهي ouhilla lighayri بيهي" وهذا هو القول، كل ما قتلت من قبل نقلا عن اسم آخر من دون الله كما فعل الكفار في عهد النبي لديهم أصنام، ذبحوا الحيوانات وقالوا "باسم اللات" أو "باسم العزى ³."

Ø الشيء الخامسة: يتم خنق الحيوان أو مخنوق كما هو مغمورة الحيوان في الماء حتى يخنق.

Ø الشيء السادس: "آل mawqoudhatou" تم ضرب الحيوان بواسطة عصا أو حجر ومات من جراء ذلك.

Ø الشيء السابع: "آل moutaraddiyatou" هو الحيوان الذي مات بسبب سقوطه من فوق.

Ø الشيء الثامنة "natihatou العام" هو الحيوان الذي مات بسبب قرونه التي حصل عليها من حيوان آخر.

Ø الشيء التاسعة: "وا أماه 'S-أكالا sabou ³ أو" هذا هو الحيوان الذي مات بسبب وحشا قد التهمت جزءا منها.

(انها بلدي dhakkaytoum) "إلا أنك قد قتل سابقا"، وهذا يعني إذا كان الحيوان هو في واحدة من هذه الحالات، ولكنها لم تصل بعد إلى مرحلة حيث تحتضر، فإنه قد تقع حيوان من فوق، ولكنه لا يزال لديه حياة مستقرة، وهذا هو القول، لو سمحت، فإنه سيعيش هو حقيقة أنه لا يزال يجعل الحركات الطوعية وقال انه لا يتصرف مثل الدابة التي قد جن جنونه. الحركات ليست طوعية، انها مثل عندما قتل يبدأ حيوان لجعل حركات لا إرادية. الشرط لأنه يجوز للاستهلاك هو أن وصلنا إلى هذا الوحش قبل أن تصل إلى مرحلة حيث يحتضر.

Ø الشيء العاشرة: "وا أماه dhoubiha ³ N-علاء nousoub" وهذا هو القول ما تم ذبحها كذبيحة للأوثان، الكفار ذبح الحيوانات ثم أخذوا الدم من هذه الحيوانات وسكب على الأصنام من أجل تمجيد الأصنام، بل هو نوع من الجمعيات.

Des choses interdites à la consommation



La louange est à Allah, le Seigneur des mondes, que Allah élève davantage le rang de notre maîtreMouhammad et qu’Il préserve sa communauté de ce qu’il craint pour elle. Nous demandons àAllah ta³ala qu’Il nous accorde à tous une bonne intention.

Allah ta³ala dit dans le Qour’an:

  ﴿حُرّمت عليكم الميتة والدّم ولحم الخنـزير وما أُهلّ لغير الله به   والمنخنقة والموقوذة والمتردّية والنّطيحة وما أكل السّبع إلا ما ذكيتم وما ذبح على   النّصب

(hourrimat ³alaykoumou l-maytatou wa d-damou wa lahmou l-khinziri wa ma ‘ouhilla lighayri l-Lahi bihi wa l-mounkhaniqatou wa l-mawqoudhatou wa l-moutaraddiyatou wa ma ‘akala s-sabou³ou ‘il-la ma dhakkaytoum wa ma dhoubiha ³ala n-nousoub)

[sourat al-Ma’idah/3]

ce qui signifie : «  Vous sont interdites la maytah, le sang, la viande du porc, la viande de l'animal égorgé en citant un autre nom que celui de Allah, la viande de l'animal étranglé, la viande de l’animal mort en recevant des coups, la viande de l’animal mort en tombant de haut, la viande de l’animal mort par des coups de cornes, la viande de l’animal qui a été dévoré par un fauve sauf ce que vous avez pu égorger auparavant et [vous est interdit] ce qui a été égorgé en tant qu’offrande pour les idoles ».

Cette ayah comporte l’interdiction de consommer certaines choses.

Ø La première chose, c’est la maytah. La maytah, c’est tout animal qui a perdu la vie à l’exception de l’animal licite à la consommation qui a été tué d’une façon conforme à la Loi de l’Islam. C’est tout animal qui a perdu la vie sans qu’il ne soit tué d’une façon conforme à la Loi de l’Islam qui le rende licite à la consommation.

Les animaux sont de deux sortes : il y a des animaux qui sont licites à la consommation, il y a des animaux qui ne sont pas licites à la consommation.

Un animal qui n'est pas licite à la consommation, comme le lion par exemple, quelque soit la façon par laquelle il est mort, il est considéré comme une maytah, sa consommation est interdite. Même si tu l'égorges, il ne sera pas licite à la consommation.

Quant à l’animal licite à la consommation, comme un mouton par exemple, s’il est égorgé d’une façon conforme à la Loi de l’Islam, il sera licite à la consommation, il sera pur. L’égorgement qui rend un animal licite à la consommation doit satisfaire des conditions. Entre autres, il ne peut être effectué que par un musulman, un chrétien ou un juif.

L’animal licite à la consommation qui est égorgé par un chrétien ou par un juif, même si en l’égorgeant il ne dit pas bismi l-Lah, cet animal-là est licite à la consommation.
Par contre, l’animal qui est égorgé par un musulman, si ce musulman en égorgeant ne cite pas le nom de Allah, selon l’imam Ach-Chafi³iyy, c’est licite à la consommation.
Selon certains autres imams, s’il délaisse délibérément la basmalah en égorgeant, l’animal ne sera pas licite à la consommation.

Selon l’imam Ach-Chafi³iyy, le fait de dire bismi l-Lah lors de l’égorgement, c’est juste unesounnah et si il la délaisse délibérément, l’animal est licite à la consommation.
L’égorgement qui est effectué par un apostat – quelqu’un qui était musulman et qui est sorti de l’Islam en insultant Allah par exemple ou en ayant une mauvaise croyance qui lui fait perdre son statut de musulman – cet animal même si il est égorgé, c’est considéré comme une maytah.

L’animal qui est égorgé par un mazdéen – quelqu’un qui adore le feu –, par quelqu’un qui adore les idoles, par un athée – quelqu’un qui ne croit pas en l’existence de Allah–, tout cela, ce n’est pas licite à la consommation.

Pour que l’égorgement soit valable, il est indispensable de couper al-houlqoum et al-mari' . al-mari' c’est le conduit de la nourriture et de la boisson  et al-houlqoum c’est le conduit de l’air, que ce soit en inspiration ou en expiration. Il est recommandé de couper al-wadajan, ce sont les deux veines qui sont d’un côté de l’autre de ces deux tubes. al-wadajan, ce n’est pas une condition de les couper pour la validité de l’égorgement. Ce qui est indispensable c'est de couper le conduit de l’air et le conduit de la nourriture et de la boisson. Mais il est recommandé de couper les quatre à la fois c'est-à-dire le conduit de l’air, le conduit de la nourriture et de la boisson et les deux veines qu'on appelle al-wadajan.

Il est indispensable également pour que l’égorgement soit valable de viser l’acte d’égorger, c’est-à-dire que si quelqu’un a un gros couteau dans la main et qu’il y a une bête qui est couchée devant lui, puis le couteau tombe sans qu’il ne fasse exprès et que ce couteau coupe le conduit de l’air et le conduit de la nourriture et de la boisson, ça ne rend pas l’animal licite à la consommation parce que il n’y a pas quelqu’un qui a égorgé en visant cet acte-là.

Certains mettent des poules dans des machines et ça passe à la chaîne sans qu’il n’y ait quelqu’un qui appuie sur un bouton à chaque poule qui passe parce que si il y a quelqu’un qui appuie sur un bouton et il y a quelque chose qui vient couper le cou du poulet, si cette personne est musulmane, chrétienne ou juive, c’est valable, mais je parle des machines où on met les animaux et on appuie juste une fois sur un bouton et après cela les animaux passent à la chaîne. Si il y a un musulman, un chrétien ou un juif qui appuie sur un bouton, la première bête sera licite à la consommation et le reste ne sera pas licite à la consommation.

Quant à l'outil par lequel on égorge, il est indispensable que ce soit quelque chose de tranchant et que ce ne soit pas une dent, un ongle ou un os. Ce n’est pas valable d’égorger avec les dents, ni avec les ongles ni avec les os. Le prophète (salla l-Lahou 3alayhi wa sallam) a interdit d’égorger avec les dents et avec les ongles. Les savants ont déduit qu’il est interdit d’égorger en utilisant un os parce que le prophète dans le hadith où il a interdit d’utiliser les dents pour égorger, il a justifié cela par le fait que les dents sont des os, c’est de là que les savants ont déduit qu’il n’est pas valable d’utiliser les os des animaux pour égorger.

La maytah, c’est tout animal qui a perdu la vie sans qu’il ne soit tué d’une façon conforme à la Loi de l’Islam qui le rende licite à la consommation. On a dit "sans qu’il ne soit tué" parce que de façon générale, sans qu’il ne soit égorgé mais il y a d’autres cas particuliers où l’animal est licite à la consommation sans qu’il ne soit égorgé, par exemple, le cas du fœtus c’est-à-dire si tu égorges une brebis qui est enceinte, une chamelle qui est enceinte, c’est licite, si le fœtus qu’elle porte trouve la mort à cause de cet égorgement, il est licite à la consommation, si en égorgeant la mère le fœtus meurt, en égorgeant la mère, la mère perd la vie et le fœtus qu’elle a dans le ventre perd la vie dans ce cas-là il est licite à la consommation sans qu’il ne soit égorgé parce que le prophète (salla l-Lahou 3alayhi wa sallam) a dit:
  
»   ذكاة الجنين ذكاة أمه   «

Ce qui signifie : « L’égorgement qui rend la mère licite à la consommation rend le fœtus licite à la consommation ».

Si en égorgeant la mère, le fœtus sort vivant, après il est indispensable de l’égorger pour le consommer. S’il sort vivant et reste pendant deux ou trois jours vivant après il meurt, il n’est pas licite à la consommation car il ne sera pas mort suite à l’égorgement de sa mère.

Un autre cas particulier, c’est le cas de la chasse. Ainsi il est licite de consommer un animal qui a été chassé, c’est-à-dire tué par une flèche, soit par une lance ou ce qui est de cet ordre, quelque chose qui tranche et qui tue. Dans ce cas, il est licite à la consommation. S’il est mort avec la flèche. Il est licite de chasser à l’aide d’un fauve ou d’un rapace, avec certaines conditions. Avant, les Arabes pratiquaient la chasse soit en utilisant des chiens ou d’autres fauves tel que le guépard ou en utilisant un aigle ou un vautour ou quelque chose de cet ordre, mais là aussi il y a des conditions : il faut que cet animal soit dressé à la chasse, pour qu’on dise d’un animal qu’il est dressé à la chasse, il faut qu'il vérifie certaines conditions. De même dans ce cas il faut que celui qui chasse en utilisant cet animal soit musulman, chrétien ou juif.


Quels sont les animaux qui sont licites à la consommation et quels sont les animaux qui ne sont pas licite à la consommation ?

Tout animal au sujet duquel il y avait un texte explicite dans le Qour’an ou dans le hadith ou dans l’unanimité des savants qu’il est licite à la consommation, il est licite à la consommation. Et tout animal au sujet duquel il y a eu un texte explicite dans le Qour’an, dans le hadith ou il y a eu unanimité des savants qu’il est illicite à la consommation, il sera illicite à la consommation.

La règle générale c’est que tout animal au sujet duquel il n’y a pas eu un texte explicite ni dans leQour’an, ni dans le hadith, ni dans l’unanimité des savants qui le déclare licite à la consommation et au sujet duquel il n’y a pas eu un texte explicite ni dans le Qour’an, ni dans le hadith, ni dans l’unanimité des savants qui le déclare illicite à la consommation et au sujet duquel il n’y a pas eu ordre de le tuer, ni interdiction de le tuer, tout animal qui est ainsi et que les Arabes considéraient comme étant bon à consommer, il est licite à la consommation. Et tout animal qui est ainsi et dont les Arabes rejetaient la consommation, c’est-à-dire qu’ils ne trouvaient pas bon en tant que nourriture, il est illicite à la consommation.

Tout animal au sujet duquel il y a eu un texte explicite le déclarant interdit à la consommation, que ce soit dans le Qour’an, dans le hadith ou dans l’unanimité des savants, il sera interdit à la consommation.

Tout animal au sujet duquel il est recommandé de le tuer, il est illicite à la consommation et tout animal au sujet duquel il y a eu interdiction de le tuer il sera également illicite à la consommation, le reste des animaux au sujet desquels il n’y a pas eu ce genre de texte, on se réfère aux Arabes. Si les Arabes de l’époque du prophète considéraient cet animal comme une bonne nourriture, cet animal sera licite à la consommation. Et si les Arabes rejetaient cet animal en tant que nourriture, il sera illicite à la consommation. Pour les animaux au sujet desquels il n’y a pas eu de texte, on se réfère aux Arabes à l’époque du prophète parce que Allah dit dans le Qour’an:
  
  «   ويحل لهم الطيبات ويحرم عليهم الخبائث     »

[sourat Al-’A³raf/157]

Ce qui signifie : « Allah leur rend licite ce qu’ils considèrent bon comme nourriture et leur interdit ce qu’ils rejètent comme nourriture »

Les premiers gens auxquels le prophète s’est adressé et notamment par ce verset, ce sont les Arabes. C’est pour cette raison que pour ce sujet, on se réfère aux Arabes. Quand on dit « les Arabes », on vise par cela les Arabes qui sont en situation d’aisance et de fertilité, on ne parle pas des Arabes qui sont en cas de famine et de sécheresse parce qu’en cas de famine et de sécheresse, les gens sont amenés à manger ce qu’ils trouvent. On vise également les Arabes qui ont un caractère normal. On ne vise pas non plus certains bédouins qui vivaient dans le désert et qui mangaient ce qu’ils trouvaient entre leurs mains, ce n’est pas à eux qu’on va se référer, on se réfère aux Arabes qui ont un caractère normal et qui sont en situation d’aisance.

Parmi les animaux au sujet desquels il y a eu un texte explicite, les déclarant interdits à la consommation, il y a le porc, il y a le mulet comme ça a été rapporté dans le hadith rapporté parAbou Dawoud, l’âne comme ça a été rapporté par Mouslim, il y a eu également interdiction de tout animal qui a des canines fortes avec lesquelles il attaque ses proies et il peut les tuer ou leur nuire gravement avec les canines, comme par exemple le lion, le tigre, le loup, le chien, l’éléphant, le chacal, le guépard, le crocodile et ce qui est de cet ordre-là et le chat également. Par contre, le renard n’est pas considéré comme un animal ayant des canines fortes.

Parmi les oiseaux, ont été interdits tous les oiseaux qui ont des griffes fortes avec lesquelles ils attaquent leur proie et avec lesquelles ils peuvent tuer ou blesser leur proie. La règle : on ne se réfère pas si le bec est crochu ou pas, la règle qui est parvenue dans le hadith, c’est que tout animal qui a des canines fortes avec lesquelles il peut tuer ou blesser gravement ses proies et tout oiseau qui a des griffes fortes avec lesquelles il attaque ses proies ont été interdits à la consommation, comme par exemple, les faucons, les vautours, les aigles, les buses et ce qui est de cet ordre.
Parmi les animaux au sujet desquels il y a eu un texte explicite les déclarant licites à la consommation, il y a les camélidés, c’est-à-dire les chameaux mâles et femelles, les bovins, c’est-à-dire les vaches, les moutons et les chèvres, les chevaux, le zèbre. Le prophète a interdit la consommation de l’âne et du mulet et il a déclaré licite la consommation du cheval et du zèbre, le zèbre il a d’autres vertus que cela, si ton regard croise le regard du zèbre, cela peut t’être très profitable pour ta vue. Parmi les animaux licites à la consommation il y a l'hyène, bien que c’est un animal qui a des canines fortes, mais comme il y a eu un texte explicite la déclarant licite à la consommation, elle est licite à la consommation.

Il est également parvenu dans le hadith que le lapin est licite à la consommation. Il y a également ad-dabb c’est comme un grand lézard qui a la queue en scie et qui vie dans la Péninsule arabe, on peut en trouver également en Ethiopie. ad-dabb a été déclaré licite par le texte du hadithdu prophète.

L’hérisson et le porc-épic sont licites à la consommation.

Tout animal au sujet duquel il y a eu un texte ordonnant de le tuer ou il est recommandé de le tuer, il est illicite à la consommation , comme le serpent, le scorpion, l'élanion (al-hada'ah).

Il y a également les animaux au sujet desquels il y a un texte interdisant de les tuer, donc illicites à la consommation. Tout animal au sujet duquel il y a eu un texte interdisant de le tuer, il est illicite à la consommation, comme la huppe, c’est un oiseau qui a comme une couronne sur la tête, une sorte de fourmi qu’on appelle « an-naml as-soulaymani », ce sont des grandes fourmis avec de longues pattes.

Tous les animaux aquatiques, c’est-à-dire qui vivent en mer, en rivière, dans un étang sont licites à la consommation sans qu’ils ne soient égorgés. Quand on dit « animaux aquatiques », on vise par cela les animaux qui vivent exclusivement dans l’eau.

Les animaux qui peuvent vivre aussi bien dans l’eau qu’en dehors de l’eau, ces animaux selon l’école de Ach-Chafi³iyy, sont illicites à la consommation, comme le crocodile, comme certaines sortes de crabes, les escargots.

Ø La deuxième chose qui est interdite dans la ayah, c’est le sang qui coule parce qu’il y a une autre ayah qui explique cela, c’est la Parole de Allah:

  ﴿   قل لا أجدُ فيما أوحيَ إليَّ محرمًا على طاعمٍ   يَطْعَمُهُ إلا أن يكونَ ميتَةً أو دما مسفوحًا     

Ce qui signifie : « Dis, je ne trouve pas dans ce qui m’a été révélé quelque chose qui est interdite en tant que nourriture à l’exception de la maytah et du sang qui coule ».

"Le sang qui coule" parce que le foie et la rate qui sont un sang que Allah a créé à l’état solide dans le corps des animaux et des êtres humains, le foie et la rate d’un animal licite à la consommation sont licites à la consommation.

Le prophète (salla l-Lahou 3alayhi wa sallam) a dit:

»   أحلَّت لكم ميتتان ودمان السمك والجراد والكبد   والطحال     »
Ce qui signifie : « Deux sortes de cadavres et deux sortes de sang nous ont été rendus licites à la consommation : les poissons et les sauterelles, le foie et la rate »

Ø La troisième chose qui est interdite dans la ‘ayah c’est la viande du porc, tout ce qui provient du porc est illicite à la consommation mais dans la ayah a été cité la viande du porc parce que c’est la viande qu’on vise dans l’animal habituellement.

Ø La quatrième chose : « wa ma ‘ouhilla lighayri l-Lahi bihi » c’est-à-dire, tout ce qui a été égorgé en citant un autre nom que celui de Allah comme le faisaient les mécréants à l’époque du prophète, ils avaient des idoles, ils égorgeait les bêtes et ils disait « au nom de al-lat » ou « au nom de al-³ouzza ».

Ø La cinquième chose : c’est l’animal qui est mort étranglé ou étouffé comme l’animal qu’on plonge dans l’eau jusqu’à ce qu’il s’étouffe.

Ø La sixième chose : « al-mawqoudhatou » l’animal qui a été frappé par un bâton ou une pierre et qui est mort à cause de cela.

Ø La septième chose : « al-moutaraddiyatou »  c’est l’animal qui est mort parce qu’il est tombé d’en haut.

Ø La huitième chose : « an-natihatou » c’est l’animal qui est mort à cause de coups de cornes qu’il a reçu d’un autre animal.

Ø La neuvième chose : « wa ma ‘akala s-sabou³ou » c’est l’animal qui est mort parce qu’un fauve en a dévoré une partie.

(‘il-la ma dhakkaytoum« sauf ce que vous avez pu égorgé auparavant », ça veut dire si un animal est dans un de ces cas mais il n’a pas encore atteint le stade où elle est en train de mourir, il se peut qu’un animal tombe d’en haut mais il a encore une vie stable, c’est–à-dire, si on le laisse, il va vivre, c’est par le fait qu’il fait encore des mouvements volontaires, il n’agit pas comme un animal qui est devenu fou. Les mouvements qui ne sont pas volontaires, c’est comme quand on égorge une bête elle commence à faire des mouvements involontaires. La condition pour qu’elle soit licite à la consommation, c’est qu’on atteint cette bête avant qu’elle atteigne le stade où elle est en train de mourir.

Ø La dixième chose : « wa ma dhoubiha ³ala n-nousoub » c’est-à-dire ce qui a été égorgé comme offrande pour les idoles, les mécréants égorgeaient les bêtes puis ils prenaient le sang de ces bêtes et le versaient sur les idoles dans le but de glorifier ces idoles, c’est une sorte d’association.

Le Cheikh Hamîd ibn ‘Atîq, qu’Allah lui accorde Sa miséricorde dit ceci au sujet de certains critères prouvant la nécessité de rompre les relations avec les mécréants et les associateurs :

Quatrième commandement : « S’asseoir parmi les associateurs dans les assemblées où ils expriment leur mécréance, sans les réprouver. Et la preuve est ce que dit le Très-Haut : 
« Dans le Livre, il vous a déjà révélé ceci : lorsque vous entendez qu’on renie les versets (le Coran) d’Allah  et qu’on s’en raille, ne vous asseyez point avec ceux-là jusqu’à ce qu’ils entreprennent une autre conversation. Sinon, vous serez comme eux. Allah rassemblera, certes, les hypocrites et les mécréants, tous, dans l’Enfer. ».

Et voici ce que répondirent le Cheikh, qu’Allah Très-Haut leur accorde Sa miséricorde, lorsqu’ils furent questionnés au sujet de ce verset, et au sujet du hadîth du Prophète, qu’Allah lui accorde la bénédiction et la paix : « Celui qui s’unit à l’associateur et habite avec lui,  alors il est comme lui. ».


Hamîd Ibn ‘Atîq -qu’Allâh lui fasse Miséricorde- a dit :

ويقول الشيخ حمد بن عتيق رحمه الله في بعض الأدلة الدالة على مقاطعة الكفار والمشركين:

الأمر الرابع: الجلوس عند المشركين في مجالس شركهم من غير إنكار والدليل قوله تعالى: {وَقَدْ نَزَّلَ عَلَيْكُمْ فِي الْكِتَابِ أَنْ إِذَا سَمِعْتُمْ آيَاتِ اللّهِ يُكَفَرُ بِهَا وَيُسْتَهْزَأُ بِهَا فَلاَ تَقْعُدُواْ مَعَهُمْ حَتَّى يَخُوضُواْ فِي حَدِيثٍ غَيْرِهِ إِنَّكُمْ إِذاً مِّثْلُهُمْ إِنَّ اللّهَ جَامِعُ الْمُنَافِقِينَ وَالْكَافِرِينَ فِي جَهَنَّمَ جَمِيعاً } وفي أجوبة آل الشيخ رحمهم الله تعالى: لما سئلوا عن هذه الآية، وعن قوله صلى الله عليه وسلم: « من جامع المشرك أو سكن معه فهو مثله ». قالوا: الجواب أن الآية على ظاهرها، أن الرجل إذا سمع شيئاً آيات الله يكفر بها ويستهزأ بها، فجلس عند الكافرين المستهزئين بآيات الله من غير إكراه و لا إنكار ولا قيام عنهم حتى يخوضوا في حديث غيره، فهو كافر مثلهم، وإن لم يفعل فعلهم، لأن ذلك يتضمن الرضا بالكفر، 

Verset :
   وَقَدْ نَزَّلَ عَلَيْكُمْ فِي الْكِتَابِ أَنْ إِذَا سَمِعْتُمْ آيَاتِ اللّهِ يُكَفَرُ بِهَا وَيُسْتَهْزَأُ بِهَا فَلاَ تَقْعُدُواْ مَعَهُمْ حَتَّى يَخُوضُواْ فِي حَدِيثٍ غَيْرِهِ إِنَّكُمْ إِذًا مِّثْلُهُمْ إِنَّ اللّهَ جَامِعُ الْمُنَافِقِينَ وَالْكَافِر ِينَ فِي جَهَنَّمَ جَمِيعًا

« Wa Qad Nazzala `Alaykum Fī Al-Kitābi 'An 'Idhā Sami`tum 'Āyāti Allāhi Yukfaru Bihā Wa Yustahza'u Bihā Falā Taq`udū Ma`ahum Ĥattá Yakhūđū Fī Ĥadīthin Ghayrihi 'Innakum 'Idhāan Mithluhum 'Inna Allāha Jāmi`u Al-Munāfiqīna Wa Al-Kāfirīna Fī Jahannama Jamī`āan »

And (Praise be to Allah who has things in heaven and on earth and praise in the Hereafter a wise expert knows what goes into the earth and what comes out and down from the sky and a limp Rahim Ghafoor).
Praise Him on Old kindness, and the frequency of grace, Hamad knows that his master decent knowledge of what he did not know, and it was a great bounty it.
And ask him more bounty, and thanks for what you prefer its grace, It has a great virtue.
May God bless Muhammad is His slave and Messenger, and the Prophet, and its secretary, vivid and slaves, have prayers satisfaction, and our forgiveness, and upon his family and companions him much good.

Said Mohammed Bin Al-Hussein: All what I said and what Sazl God willing, described in the Book of Allah Almighty and Sunnah of the Messenger of Allah peace be upon him, and telling his companions, God bless them and other scientists, and I will mention him what Houdrna mentioned, God willing, God bless it. God Almighty said (Those who recite the Book of Allah and establish prayer and spend of that which We have given them secretly and openly, hope trade will never fail to Eoffém wages and gives them increase of His bounty He is Forgiving, thanks).
The Almighty said: (this Qur'an guides to that which is doing and heralds the believers who do good deeds that they have a great reward. But those who believe not in the Hereafter, We have prepared for them a painful punishment).
The Almighty said: (And We send down of the Qur'an that which is a healing and a mercy for believers and not more than the oppressors only ruin).
The Almighty said: (O people may جاءتكم the admonition from your Lord and a healing for what is in the breasts and guidance and mercy for the believers).
The Almighty said: (O people, has come to proof from your Lord, and sent down you Nora noting. Those who believe in Allah and hold fast by Himself in him and the virtue of mercy and guide them to Himself by a straight).
The Almighty said: (And hold fast to the rope of Allah and be not divided among yourselves).
The rope of God is the Koran.
The Almighty said: (Allah sent down the best modern a similar cystic chilling book him skins who fear their Lord, then soften their skins and hearts to God the guidance of Allah guides whom He wills, and whom Allah for him there is no guide).
The Almighty said: (and also sent down the Koran Arab and spent a stern warning that they may fear or happen to them male).
Then Allah Almighty has promised to those who listened to his words so well when listening without literature considered beautiful, and the need to be followed and work him, يبشره him all the best, and his promise to better reward.
He said Almighty فبشر (Ebadi who listen say tracking Well those who Allah has guided, and those are men of understanding).
